Omisi贸n legislativa de cumplir con obligaciones establecidas en una disposici贸n convencional o internacional, cuando exista un mandato constitucional; Personas desaparecidas y declaraci贸n especial de ausencia, obligaciones internacionales del Edo Mexicano en esa materia.
La SUPREMA CORTE DE JUSTICIA DE LA NACI脫N (SCJN), dio a conocer las diversas TESIS y JURISPRUDENCIAS en MATERIA ADMINISTRATIVA, publicadas el pasado d铆a 10 de noviembre de 2023, donde se aprecian los siguientes criterios:
- OMISI脫N LEGISLATIVA DE CUMPLIR CON OBLIGACIONES ESTABLECIDAS EN UNA DISPOSICI脫N CONVENCIONAL O INTERNACIONAL. SE CONFIGURA CUANDO EXISTA UN MANDATO CONSTITUCIONAL DERIVADO DE LOS COMPROMISOS INTERNACIONALES ADQUIRIDOS POR EL ESTADO MEXICANO QUE OBLIGUEN A LOS PODERES DEL ESTADO MEXICANO A ADECUAR SU NORMATIVA INTERNA.
- PERSONAS DESAPARECIDAS Y DECLARACI脫N ESPECIAL DE AUSENCIA. CONTENIDO Y ALCANCE DE LAS OBLIGACIONES INTERNACIONALES DEL ESTADO MEXICANO EN ESA MATERIA.
